Course aim
This course looks at both the IEI conditions of contract 3rd edition and the new public works contracts. Contractual solutions will be dominant on the course but practical, non adversarial solutions will be discussed in the context of good practice.
Overview
Many different firms participate on any one construction project. All these firms are joined by contracts. The law of contract makes co-ordination of the construction activities possible.
Standard forms of construction contract have been used for many years. It is these contracts that define the responsibility of the contractor to construct and the client to pay. These obligations need to be understood to avoid disagreement. The obligations and powers of the client’s agent – the engineer or employer’s representative – and the contractor need clear definition.
The standard forms of contract set up a framework for the administration of the contract. This course looks at both the IEI conditions of contract 3rd edition and the new public works contracts. Contractual solutions will be dominant on the course but practical, non adversarial solutions will be discussed in the context of good practice.
The course covers these aspects and in addition gives participants the confidence to:
- Discuss the basic law of contract/contract execution
- Define the roles of the parties and the documentation
- Critically analyse the contract between client and contractor
- Offer solutions to existing contractual problems
- Offer solutions that will avoid contractual problems
- Administer construction contracts either as engineer or contractor
Who should attend?
All those involved in the execution of construction work and who need to raise their commercial awareness, both contractor’s staff and engineering staff who are currently working or are about to work on site.
Trainer's profile
James Golden, BEng LLB CEng FICE MCIArb FInstCES MRICS
James is a barrister, chartered engineer and surveyor. He is widely experienced in all aspects of construction claims and dispute resolution. Always commercially minded, he has a reputation of grasping the key issues quickly and thoroughly with the ability to explain them to decision makers and clients alike.
James’ experience includes advocating for clients and acting as an expert witness. He regularly acts as contract administrator and/or project manager and also acts as an examiner of the institution of civil engineers.
