Course Overview

An Introduction to Private Sector Contract: Conditions of Contract for Building and Engineering Works designed by the Employer (“PSC”) is a full one-day course intended for private sector companies who are interested in working with PSCs in or may be engaged under them in the future. This course is intended to provide an in-depth understanding on the various contractual provisions within the PSC.

Course Aim

The aim of the training is to provide a general overview of the newly launched PSC and to improve the awareness and knowledge of the attendees on the various contractual provisions and procedures that are applicable to PSC. Our objective is to ensure that attendees understand the terms and operation of the PSC and approach them practically and professionally.

This course will include an introductory level focus on:

  1. Introduction and background of the PSC;
  2. Objectives and the intention of the PSC;
  3. Comparison with the provisions of Public Works Contract;
  4. Risk Management;
  5. Roles and Responsibilities;
  6. Delay and Compensation Events- Remeasurement;
  7. Payment Provisions;
  8. Dispute Resolution and Termination;
  9. BIM; and
  10. How the PSC deals with Covid-19.

Course Objectives

The objectives of the training include:

  • Ensuring that participants understand implications of the contractual terms of the PSC;
  • Ensuring that participants understand the contractual mechanisms of the PSC;
  • Ensuring that participants understand the impact and effect of the procedures as set out in the PSC and their obligations of different parties within them; and
  • Improving the timely completion of projects and to provide the knowledge necessary for participants to approach PSCs practically and professionally.

Learning Outcomes

After this course, participants should be better able to understand the:

  • Objectives of the PSC;
  • New clauses introduced in the PSC;
  • Roles and responsibilities of the Employer, the Employer’s Representative, the Contractor, the Contractor’s Representative, the Specialists/Sub-Contractors and Project Supervisor;
  • Procedure involved with compensation events and dispute resolution; and
  • Payment mechanism under the PSC.

Trainer's profile

James Golden

James has over 30 years’ experience working with major consultants and contractors throughout the UK, Ireland, Hong Kong and the Middle East.  He has extremely strong practical and theoretical knowledge on all the standard forms of building contracts used in the UK and Ireland and has provided advice to central governments, local governments, and contracting organisations on contractual and disputed issues.  He regularly represents parties in ADR forums, including adjudication, conciliation, mediation, and arbitration.

James is experienced in all aspects of dispute resolution and large-scale project management.  He is a practising adjudicator: a member of a number of appointing body panels including the Institution of Civil Engineers, TeCSA and the ministerial panel in Ireland.

James’ experience includes acting as an Expert Witness in arbitration and litigation.  He has acted as an expert on programming and commercial matters in litigation and arbitration.

James is an active member of a range of organisations including the ICE, the Society of Construction Law, the Adjudication Society, the Institution of Civil Engineering Surveyors, the NEC users group and also serves on the ICE DRP committee.
